I never expected this, but again I'll be "nice" and refrain.........

So... I NEVER got to cruise side by side with Tufsig.

GSR GK - GSR GJ

And thats almost as annoying as being lied to by my mechanic

He was the last one that was working on it before it caught fire, and if you did no work to it yourself, or had anyone else touch the engine bay, then it obviously is something he did. It's not like your car was on fire, or caught fire, before Flav worked on it. I can see now that even before you get some kind of compensation from him, he'll start hurting cause no one will want him touching their cars.

Maybe - but he's the "Guru" and I'm sure this can be "explained", his idea of compensation is an insurance scam.

I'm not interested.

And this is NOT going to be pretty - I apologise to all those that kiss his feet - but this is wrong!

What he's saying is it's not his fault the thing caught fire - and that there-for he's not obligated to repair it.

For you it would be easier to just transfer your Tufsig motor into it (complete with loom), as then the guards and bonnet could be transferrred.

I'm NOT giving this guy any more money - but I'll help you have what I wanted in the first place...

I'm broke 10k spent, everything replaced new, all you need to do is replace firewall forwards.

The IRS should mount to the Aus-Spec Sigma. You might need to weld in rear strut towers for the rear shockers. But, wrecking the car isn't the answer. Flav fixing it is. If you were wrecking it, I'd like the wheels, but you can't wreck it! It is such an awesome car!

I've spent everything I own on this car.

It was a carefully planned exercise, except that new things kept cropping up.

I'm a simple man - just ask Luke

The wheels are Simmon's with pro comp medium compound racing tyres on them, low profile.

They'll fit any Galant.

Including GC75's

If it was a fuel leak which was ignited by an electrical fault, it is still his fault since he would have done the fuel lines. I am not 100% sure, but I don't think a faulty relay would do that much damage. But yeah, legal way is the best way. Even though it wouldn't be as satisfying, it'll still be a result.

done some research for ya...

Obligations of repairer

A motor vehicle repairer has a responsibility, as with any other trade to ensure that the work carried out is done in a ‘workmanship like manner’. This is a responsibility brought under the Fair Trading legislation, other similar legislation, and common law.

If a part fitted by a workshop is defective, substandard or unfit for its intended purpose, and if it is the ‘cause’ of an accident, a customer (but not another person such as a passenger, pedestrian or subsequent owner of a vehicle) can bring a contractual claim against the workshop under section 74 of the Trade Practices Act 1974.

A claim could also be brought under section 74 if the workshop did not exercise due care and skill in carrying out repairs or testing.

Section 74 implies a non-excludable warranty into contracts for the supply of services by workshops to customers:

* that services will be carried out with due care and skill and
* that any components supplied in connection with those services will be reasonably fit for the purpose for which they are supplied.

Similar warranties are implied by common law into contracts for the supply of services by workshops.

For example, if a customer could establish that a workshop did not exercise due care and skill in fitting a disc brake calliper, or if the customer could establish that a disc brake rotor fitted by the workshop was below recommended minimum operating thickness, the workshop could be held liable to the customer under section 74 or under common law.

Loss/damage to vehicle

A dealer or repairer may be liable for loss or damage when this occurs while the vehicle is in the dealer’s or repairer’s, or a sublet repairer’s custody waiting for repairs under warranty.

If you believe that the repairer has acted in a dishonest or fraudulent manner you should report it to Fair Trading, who will investigate your complaint.

-------

Pretty sure we have worked out he didnt attend something or rather properly..

therefore he is infact liable.

I am no expert, but yes, Relays do deal with high voltages. if there was a short in the relay, it might melt the relay, melt the relay holder, melt things around it, but it wouldn't be enough to melt things on the other side of the engine bay. The only way to get that kind of heat and fire damage to the entire engine bay is to have something flammable catch alight. In the engine bay, that would be petrol or oil. A properly set up engine bay is set up to keep anything flammable from getting out, and causing a fire like this.

I've also checked all that out, and yes you're correct.

But it'll take 6 months for them to query it, and by then the rego has run out.

In that time I've still not got my car, and have had to store what's left of it.

He's very lucky I was in it alone, as if those I love had been in it to share the experience.........

The most common causes of
fires are:
• Arcs on the starter (or battery
cables), the alternator cable
or the positive feed wire into
the cabin.
• Flammable material resting
against the turbo charger
or the exhaust.
• Rubs on the fuel lines that result
in leaks and then a fuel mist
in the engine compartment.
• Turbo charger failures that
cause excessive temperatures
in the exhaust.
• Leakage of hot gases from
the exhaust.
• Electrical arcs at terminals or
connectors resulting from hot
terminals that cause insulation
to melt and catch fire.
• Addition of heavy add-on loads
onto a circuit not intended for
it. If the fuse rating is increased,
the wiring may not be adequately
protected.
• Tyres catching fire because
they are flat or poorly inflated
or rubbing on hard surfaces.
• Wheel bearing failures resulting
in bearing grease catching fire.
Sometimes overheated brakes
do the same.
• Road debris that catches under
vehicles and is combustible.

----

Occasionally starter relays weld
on due to high inrush currents.
If the relay contacts weld together,
the starter motor will run continuously
and overheat, potentially leading to fire.

Thats pretty much the only way a relay can start a fire...

What you said isn't that harsh. If you paid any other business for a service that they completed unsatisfactorily, they would have to remedy it no matter what was happening in there personal life, so why shouldn't they?

The starter motor cables and wiring inside the battery box should always be scrutinized for signs of arc damage.
Evidence that steel parts have been exceedingly hot (causing bluing and/or melting) often indicates the site of a short-circuit.

Although in your case id say it was the fuel lines on due to the amount of heat that was issued on that side of the engine bay.

indeed id be taking this to court!

They are trying to get sympathy or a reason for him to lay off the case... therefore somewhat shows his guilty and has to use his kids to throw off the matter, because he himself knows his in the shit.

Everyone knows family matters really dont come into place when work is involved.. work is money... if everyone brought there personal life into shit nothing would work.. its just an excuse or a throw off... which i seem to know all to well..

Pretty much dealt with people that lied/manipulated/connived my whole teens years which also involved money. Even i know when money is involved no one gives a stuff.

Reputation is what makes or breaks you in the automotive industry and zoom tunings future is not looking to good best of luck with the restoration of a truly beautiful car.

The level of damage to the engine bay is unreal, I've not yet moved the car - still in a "holding pattern" with where to move it to.

Waiting on lawyers to return my calls.

And waiting to hear from a gent that does forensic fire analysis on motor cars, for litigation etc.

At least I'm no longer shaking.

Hey man, thats a damn shame!!!!

Ok If i may can i make some suggestions.

Great to hear you are seeking legal advice!!

I was going to suggest you get it to a NRMA accessor and get them to see if they can pin point the start point, but sounds like you are already on it!

Did you get any form of Receipt, or written discription of the work he carried out from this guy that you could use as proof that he has done the work?
It would be good for Legals.

Man Next big suggestion,
This is a forum,
Anyone can access it!

I would highly recommend that You remove all photos and questions, and politely PM and ask that all Comments and statements in regard to your Fuel tank problems.
Be permanently removed!!!!!!

He or an accociate of his could access this site, and copy this and use it as evidence in court against you!!!

I would also strongly advise you remove any and all comments RE any personal threats toward him! for the same reasons.

Man I have never heard of a Relay shorting so badly that is actually caused a fire of any desciption, but i would be calling some Older Auto Electricians that have been around along time!
and worked on Older models of all descriptions.

A relay is simply a way to use a small amount of current, to control a larger amount of current.

As you activate a switch, a small amount of current is sent throught the switch to the relay, where a coil creates a small magnetic current.
This pulls an internal Gate closed within the Relay.
This Enables a Larger current to flow.

All that can happen would be a short, then the relay stops working!
If the relay doesnt work, then there is no power getting through it.

But as i said Older Lecos will be your best source of knowledge, and past experiences!!!

Be careful destroying him if it turns out he wasnt at fault!
Man you may not have kids, but Family does have to come first for anyone.
Its a shame what has happened, And i totally understand how pissed off you were!!
But i dont think anyone was going to bother stealing it in its present condition ;)

I hope you get to the bottom of it and gain some sort of compensation

All the best

I have no problems with people reading how I feel

If any of you know this gent - I advise you get him to call me, and not call my bluff !!

I care not any more what law officials read on this site

I'm very upset at being left in the dark, and the rest you'll read tomorrow

I DON'T have kids, or anyone else to be afraid of their safety.

Ciao

You're right - I'm past caring

[7/6/2009 6:06:04 PM] Lowmion: My friends say that your plan would work, that I should offer you 3 out of the 15k for your troubles, that I should give you a time limitation and that if it's insured via your business, the rates would be way cheaper. I'lll come see you tomorrow - I'll get the "cute chick" to drive me, so that we can talk - I've alot of doubts - and I don't need my friends trying to "help" me just yet. Matt (aka sigma boy)

I can empathise with you on how you must feel, but you have to keep a cool head about it. If I had your car, and someone did the same thing, I would be as eager to take the damages out with a baseball bat, but it isn't the way to go about it. it is a little unfair that he has left you in the lurch like this. The least he could do is keep some contact to see what is happening, and offer help even if he is away. Stay the course, get the compensation, and get your baby fixed.

Does anyone know of a mechanic and an auto electrician that can come visit and supply a quote for the repairs needed ?
